BC Pre-Sale Deposit Structure Explained — What to Expect Before You Sign

Why Deposits Work Differently in Pre-Sale

When you buy a resale home, you typically put down a deposit of 5–10% at the time of offer. Pre-sale is different. Because you're buying a home that doesn't exist yet — often 1–3 years from completion — developers use a staged deposit structure that spreads your payments over time.

Understanding how this works is one of the most important things you can do before signing a pre-sale contract in BC.

What Is a Staged Deposit?

A staged deposit is a series of smaller payments made at set milestones leading up to completion. Instead of paying 10% all at once, you might pay:

  • 5% at signing (within 7 days of contract execution)
  • 5% at a second milestone (e.g. 90–180 days later, or when a set percentage of units are sold)
  • Remaining balance at completion (when your mortgage funds)

Total deposits typically range from 5% to 15% of the purchase price, depending on the developer, project type, and market conditions.

Where Does Your Deposit Go?

This is one of the most common questions buyers ask. In BC, pre-sale deposits are legally protected. Under the Real Estate Development Marketing Act (REDMA), your deposit must be held in a trust account by a lawyer, notary, or the developer's brokerage until specific conditions are met.

Your money does not go directly to the developer to spend on construction — it sits in trust, protected, until completion. This is a significant consumer protection unique to BC's pre-sale market.

What Happens at Completion?

At completion, your mortgage funds. Your total deposit held in trust is credited toward the purchase — it is not an extra cost on top of your down payment.

Example: You buy a $750,000 pre-sale condo. You've paid $75,000 in deposits (10%). At completion, your mortgage covers the remaining $675,000 (minus any additional down payment funds). Your $75,000 deposit is applied directly to the purchase price.

Can You Lose Your Deposit?

In most cases, no — as long as you complete the purchase as agreed. However, if you default on the contract without a legal basis, the developer may be entitled to keep your deposit as damages.

You also have a 7-day rescission period after signing a pre-sale contract in BC — you can cancel for any reason within this window and receive a full refund. After 7 days, cancellation rights are limited to specific legal grounds outlined in your contract.

Tips for Managing Your Pre-Sale Deposit

  1. Keep deposit funds liquid — don't invest your deposit money in volatile assets. You need it available at each milestone date.
  2. Know your milestone dates — mark each deposit due date in your calendar well in advance.
  3. Get mortgage pre-approval early — you'll need to re-qualify at completion based on your income and interest rates at that time. Start planning early.
  4. Read the assignment clause — if your situation changes and you need to sell before completion, your ability to assign the contract depends on what the developer allows.
  5. Work with a specialist — deposit structures vary significantly between projects. A pre-sale specialist like Parnam Singh can explain exactly what to expect for any specific project before you sign.
